Vitalize — Terms of Service

1) What Vitalize is (and isn't)

Vitalize is a consumer wellness app that helps you track meals, gut-friendly habits, and symptoms and provides automated coaching.

Always consult a qualified professional for medical concerns. Do not use the App in emergencies.

2) Eligibility & accounts

You must be 16 or older and legally able to form a contract. You may use anonymous sign-in or Sign in with Apple/Google.

You are responsible for your device and for keeping the App updated.

3) Subscriptions & billing

Some features are free with usage limits; Vitalize Pro unlocks additional features.

• Purchases are processed by Apple App Store / Google Play. Prices may change; taxes may apply.
• Subscriptions auto-renew until you cancel in your App Store settings at least 24 hours before the renewal date.
• Refunds are handled by the applicable store under its policies.
• We may offer trials or promotions; eligibility is at our discretion.

4) Acceptable use

You agree not to:

• Reverse engineer, copy, or modify the App
• Use it for unlawful, harmful, or deceptive purposes
• Upload content you do not have the right to share
• Attempt to bypass free-tier limits or abuse promotions (we use a local, hashed device fingerprint solely to enforce limits)

5) User content & permissions

Most content (meals, scores, correlations) remains on your device. If you choose to:

• Send a meal description for AI analysis: you grant us a limited license to process that text to provide the response.
• Enable data sharing for model improvement (if offered): you may opt in to share select anonymized items. You can revoke at any time; this will stop future sharing.

You represent that your submitted content does not infringe others' rights.

6) Integrations

If you enable Apple Health/WHOOP, you authorize us to read selected metrics to provide features you request. You can disable at any time in device settings. We don't write to Apple Health.

7) Intellectual property

The App, trademarks, and content are owned by BetterVue e.U. or its licensors and are protected by law. You receive a personal, non-exclusive, revocable license to use the App for your own non-commercial purposes.

8) Beta features & AI outputs

Use your judgment and do not rely on them for medical decisions.

9) Disclaimers

The App is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties (express or implied), including fitness for a particular purpose and non-infringement.

10) Limitation of liability

To the maximum extent permitted by law, BetterVue e.U. and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the App.

Our aggregate liability will not exceed the amount you paid for the App in the twelve (12) months before the event giving rise to the claim (or €50 if no payments were made). These limits do not exclude liability that cannot be limited under applicable law.

11) Termination

You may stop using the App at any time and can delete your account/data in Settings. We may suspend or terminate access for material breach, abuse, or legal risk, with notice where practical.

12) Governing law & venue

These Terms are governed by the laws of Austria, excluding conflict-of-laws rules. Courts in Vienna, Austria will have exclusive jurisdiction, unless mandatory consumer laws provide otherwise.

13) Changes

We may update these Terms to reflect new features or legal requirements. If changes are material, we'll notify you in-app or via the stores. Continued use after the effective date means you accept the revised Terms.
